Chanyl Media is a sole proprietorship owned and operated by Chandler Wilburn ("Chanyl Media," "I," "me," or "my"), based in Austin, Texas, and is not currently organized as a limited liability company or corporation. Because of that, Chandler Wilburn is personally responsible for the operation of this business, consistent with how sole proprietorships work under Texas law. By using this website ("Site") or engaging Chanyl Media for services ("Services"), you ("Client," "you," or "your") agree to the terms below.
Chanyl Media provides web design, search engine optimization (SEO), content planning, sales funnel development, social media management, AI receptionist setup and management, and paid advertising management on either a done for you or done with you basis. The specific scope, deliverables, timeline, and price for any engagement will be confirmed separately in writing (including by email) before work begins ("Project Scope"). These Terms apply in addition to, not instead of, any Project Scope agreed to between you and Chanyl Media.
Marketing, advertising, search rankings, and social media performance depend on many factors outside of Chanyl Media's control, including but not limited to platform algorithm changes, market conditions, competitor activity, your industry, and your own responsiveness and follow-through. Chanyl Media does not guarantee specific results, including but not limited to a specific number of leads, a specific search ranking, a specific return on ad spend, or a specific revenue outcome. Any figures shown on this Site, including the Results page, reflect aggregate or illustrative performance and are not a promise of what your business will achieve.

You agree to provide timely feedback, necessary access (such as domain, hosting, or ad account access), and accurate information about your business needed to perform the Services. Delays caused by missing information, late approvals, or unresponsiveness may affect project timelines, and Chanyl Media is not responsible for delays caused by the Client.
Upon full payment for a completed website or content deliverable, ownership of the final delivered files transfers to the Client, excluding any third-party assets (such as licensed stock photography, fonts, or software) which remain subject to their original license terms. Chanyl Media retains the right to display completed work in its own portfolio and marketing materials unless the Client requests otherwise in writing.
Certain Services rely on third-party platforms, including but not limited to Meta, Google, form and automation providers, and AI-based call and text handling tools. These platforms have their own terms of service, pricing, and policies, which are outside of Chanyl Media's control. Chanyl Media is not responsible for outages, policy changes, account suspensions, or pricing changes made by these third parties. The AI receptionist service uses automated systems to interact with callers and texters; while designed to be accurate and helpful, it may occasionally misunderstand a request or provide an imperfect response, and is not a substitute for direct emergency communication.
By using this Site, you agree not to: attempt to gain unauthorized access to any part of the Site or its underlying systems; use automated tools to scrape or copy content without permission; submit false information through the contact form; or use the Site for any unlawful purpose. Content on this Site, including text, design, and the Chanyl Media logo, is the property of Chanyl Media and may not be copied or reused without permission.
This Site and the Services are provided "as is" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by Texas law.
To the fullest extent permitted by law, Chanyl Media's total liability for any claim arising from the Services or this Site is limited to the amount paid by the Client for the specific Service giving rise to the claim in the preceding three months. Chanyl Media is not liable for indirect, incidental, or consequential damages, including lost profits, arising from the use of the Services or this Site.
You agree to indemnify and hold Chanyl Media harmless from any claims, damages, or expenses arising from content you provide for use in your website, ads, or social media, including claims that such content infringes on a third party's rights.
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or the Services will be resolved in the state or federal courts located in Texas.
Chanyl Media may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site or Services after changes are posted constitutes acceptance of the updated Terms.
